Terms & Conditions

 

WARRANTY / REVISIONS / PRIVACY / POLICY

Basic Warranty and Revisions Policy: If for any reason you are not satisfied, We will do up to 2 revisions for free to fix it. After the 2nd revision, we will charge full rates for any following revisions. No refunds.


Monthly Mastering / Mentoring Membership Subscriptions Policy

1. You will be automatically billed each month.

2. You can cancel anytime.

3. You can share your monthly credits with a friend.

4. Your UN-used monthly credits carry over each month.

5. ALL unused / carry-over monthly credits will expire at the end of each year on DEC 31st or at the time of cancelation, which ever comes first.

6. We do not pro-rate your subscription rate for any used portion of a billed month.

7. ALL shared files will be deleted after 90 days. You must request copies or move all files prior from our Dropbox folder or they will be deleted.

8. Mastering Warranty & Revision Policy:

If you are not satisfied with your Final Master, we will do up to (2 Revisions for Gold & Platinum | 1 Revision for Silver) for free to fix it. After the 2nd Revision we will charge full retail Mastering pricing on each following Revision. Platform Specific Mastering available upon request and may result in an additional fee.


Mastering Policy

1. Mastering is not completed until payment has been received.

2. Completion time is 2-3 Business Days after payment has been received and acceptable files have been provided to Dark Star and barring any unforeseen circumstances.

3. Warranty & Revision Policy: If you are not satisfied with your Final Master, we will do up to 2 Revisions for free to fix it. After the 2nd Revision we will charge full retail Mastering pricing on each following Revision.

4. Credits: ONLY When Applicable Mastering Credits Must Be Given To: RYAN MICHAEL ROBBINS & BRUCE MAC VAUGHN

5. Session files will be deleted after 90 days. You must request copies or move all files prior from our Dropbox folder or they will be deleted.

6. Platform Specific Mastering available upon request for an additional fee.


Mixing & Mastering Policy

1. Mixing is not completed until initial payment has been received.

2. Completion time is on average 10-14 Business Days after payment has been received and acceptable files have been provided to Dark Star and barring any unforeseen circumstances.

3. Session files are NOT included in the price, but can be provided for an additional fee. CONTACT US

4. If you decide to replace any files / channels after the mixing and or mastering worked has started, you will be charged an hourly rate for the required labor to implement the file(s) / channel(s) properly mixed back into the project.

5. Warranty & Revision Policy: If you are not satisfied with your Final Mix, we will do 2 more Revisions for free to fix it. After the 2nd Revision we will charge our current hourly rate for all following Revisions on the remainder of the Mixing process.

6. Credits: When Applicable Mixing & Mastering Credits Must Be Given To: RYAN MICHAEL ROBBINS & BRUCE MAC VAUGHN

7. SYNC & BROADCAST ROYALTIES: Unless Otherwise Agreed Upon, Industry Standard Royalties Will Be Expected.

8. ALL Session files & Stems will be deleted after 90 days. You must request copies or move all files prior from our Dropbox folder or they will be deleted.

9. Platform Specific Mastering available upon request for an additional fee.

10. Your Mixing Rate is based on a specific number of hours. Additional Mixing Time and Revisions will be billed at current hourly rate.

11. If files are sent incorrectly, we may use time to mentor / assist with file delivery and deduct the necessary time form the portion of the paid session or total job rate.


Mentoring Sessions & Music Production Policy

1. Mentoring Sessions / Music Production is not completed until initial payment has been received.

2. Completion time varies per project and averages between 2 & 6 In-Studio Sessions or 14 to 21 days for remote.

3. Payments are due prior to starting the project.

4. Project Session files ARE included for all Mentoring Sessions. Project Session files are NOT included in the price for Production work, but can be provided for an additional fee. CONTACT US.

Sound Design Policy

1. Sound Design is not completed until payment has been received.

2. Completion time varies and is agreed upon on a per project basis.

3. A minimum of 50% of the total project invoice is due prior to starting the project.

5. Warranty & Revision Policy: If you are not satisfied with your Sound Design, we will do 2 more Revisions for free to fix it. After the 2nd Revision we will charge our current hourly rate for all following Revisions on the remainder of the Production process.

6. Credits: When Applicable Sound Design (And Any Other Applicable Credits) Must Be Given To: Dark Star Audio

Scheduling & Cancelation Policy

1. Client is responsible for scheduling & attending their appointments.

2. Appointments can be made through our website: SCHEDULE APPOINTMENTS HERE

3. We request payment in full before all sessions unless otherwise agreed upon.

4. If you need to reschedule, please provide us a minimum of 24 hours notice.

5. Failure to reschedule with a minimum of 24 hour notice will result in loss of payment for that scheduled service.

5. Cancellations, without rescheduling require 7 days notice.

6. Failure to cancel with a minimum of 7 days notice may result in loss of payment for the scheduled service.


Studio Use Policy

The Studio Use Policy is intended for those who enter any Dark Star Studio. Please take a moment to Familiarize your self with the studio policy. A clear understanding may reduce confusion later on.

1. We request payment in full before sessions. Studio Sessions are subject to Appointments & Cancelation Policy.

2. When you schedule studio time, it is expected you will arrive on time and we adjust our schedules accordingly. It should be understood that we will bill you from the beginning of your scheduled time regardless of what time you arrive. Studio time is billed by hour and only in full hour increments.

3. We do our best to be flexible. Often another session is scheduled immediately following yours and in most cases we allow at least 15 minutes leeway between sessions. We allow up to 15 minutes of time for you to transition in and out of the studio. We ask that you be considerate and stop what you are doing in the appropriate amount of time to not exceed the 15 minute transition window. If nobody is scheduled after you, we may allow you to continue working. If so, we will bill you for another 1 hour minimum.

4. Food and Drink may be brought into the studio but MUST be kept away from ALL equipment. You are responsible for any and all damages from food and liquid.

5. Smoking is prohibited on the premises by order of the Fire Marshal. If you choose to smoke outdoors, please use the designated smoking area outside the gates of the property.

6. We reserve the right to deny access to our premises and our equipment to those clearly under the influence of drugs and alcohol.

7. Dark Star Audio shall be held harmless for any and all damage that might occur to any stored medium for any reason. In any event, Dark Star Audio shall be limited to the replacement cost of a comparable file. Dark Star Audio shall not be held liable for anytime “downtime” for any and all studio sessions as a result from equipment malfunction or availability, personnel, hired help, acts of God, Nature, or public Utility outages etc

8. All Clients and Guests are responsible for any and all damages that may result from any of their doing, even if by accident, for any damages caused, other than normal wear and tear, we enforce “If you break it, you buy it” policy.


Artist Development Policy

1. Dark Star Audio does not guarantee your industry success, but will share our decades of knowledge with you.

2. All Services / Mentoring / Information /Time and Work of any sort provided by Dark Star Audio is tracked / monitored and deducted from the total amount billed for the Artist Development paid by or on behalf of the client / Artist. Deductions are based on service type or current hourly rate.

3. Client(s) and Artist(s) or any other person or Person(s) participating in the Artist Development must sign and adhere strictly to the Non Disclosure Agreement & Non Compete Agreement provided by Dark Star Audio.

4. Artist Development begins within 14 Business days after the fee has beencollected by Dark Star Audio.

5. The duration of the Artist Development varies per package, with a minimum of 14 weeks and the expiration of the Artist Development is outlined in the contract. You must complete your hours within that time frame or they will expire.

6. The client is responsible for scheduling their sessions in advance, each week based on the project management schedule provided. Failure to schedule and or attend will result in loss of service / hours for that week and will be deducted from the total time allocated to the Artist Development program.

7. The Artist Development will include various types of services may include, but not limited to: Design Services / Sharing Industry Knowledge / Mentoring / Brainstorming / Consultation / Guidance. This is not an all inclusive agreement and
some services may be subject to additional fees.

8. Client may quit at anytime, but there are NO REFUNDS, NO PRO RATIONS or CREDITS.

9. Artist Development clients are subject to all other policy listed by service.


Producer Tools Policy


1. CONTENT DATA: The purchase or use of sample sounds or loops from this web site is not a purchase of software. Sample sounds or loops consist of content data files only. You understand that the purchasing or licensing of software is a separate purchase from the purchase of sample sounds or loops.

2. ROYALTY FREE: Dark Star Audio Producer Tools sample sounds and loops are royalty free. This means that you have the non-exclusive right to use them freely in any sound and/or audiovisual production without additional compensation to Dark Star Audio, except that:

3. You may not distribute, sell, assign, license or otherwise transfer any of the sounds or loops except as incorporated in a production. You may not distribute the sounds or loops without the production of music and/or vocal production added. You may not distribute the sounds or loops, either in native format or reformatted, for use as sounds, multi-sounds, samples, loops, multi-samples in a sampler, sample playback unit, web site, computer or other media.
